Do We Treat Our Employees like Robots? Expectations of a Generationally-Shifted Workforce

Mischief in the Metaverse: Managing Menacing Avatars in the Virtual Workplace

The metaverse is no longer something of the future. It is here and already delivering benefits like lower costs, faster time to market, and a greater sense of inclusion. However, when transitioning to a fully immersive virtual workplace, there are a number of novel challenges that employers will face in relation to their new parallel workforce. This session will focus on misconduct-related challenges in the metaverse.

In a world where your employees have avatars, there is increased opportunity for misbehaviour. Research shows that when individuals create avatars of themselves, they will either extend their personal (real) identity or construct a separate, virtual identity apart from their real-life self. The level of the owner’s identification with the avatar is often associated where the avatar sits on this scale. Research suggests that where the owner of the avatar does not identify with the persona they have created, they may potentially be more willing to, through their avatar, conduct themselves in a manner which they would not, ordinarily. In this context, employees may feel emboldened to sexually harass co-workers, urinate in the office pot plants or turn up to the workplace in inappropriate attire (or no attire at all). The realms of possibility are endless.

Most employment laws, policies and practices are geared towards life in the real world, not in the virtual world. Questions arise as to, if the misconduct happened in the virtual world, whether it happened at all? Whether an employee can be found guilty of sexual harassment if the victim is an avatar? Whether, if a virtual object is stolen, damaged or soiled, an employee be held liable for any loss and whether an act such as virtual theft serves to breakdown the trust relationship between the real life employee and their employer? We will discuss these questions and more during the course of session.

The team of lawyers identified pain points and inefficiencies in the contract drafting and management processes.
